Acceptable Use Policy

1. Scope

This Acceptable Use Policy ("AUP") describes prohibited uses of VocalMax and is incorporated into our Terms of Service. By using VocalMax, you agree not to use the Service for any of the activities described in this AUP. Violation of this AUP is grounds for immediate suspension or termination of your account, deletion of generated content, and forfeiture of any unused subscription time or Word Pack credits.

This AUP applies to all uses of VocalMax — by subscribers, organizations, and anyone authorized to access the Service through your account.

2. Prohibited Content — You May Not Generate

You may not use VocalMax to create, generate, distribute, or publish audio content that:

2.1 Illegal Content

• Violates any applicable law in the jurisdictions where you create or distribute the content.
• Constitutes child sexual abuse material (CSAM) or sexualized content depicting minors in any form. We have ZERO TOLERANCE for any such content. We will report violations to law enforcement and the National Center for Missing & Exploited Children (NCMEC) or applicable Canadian authorities.
• Promotes, depicts, or incites violence, terrorism, or unlawful armed activity.
• Provides instructions for creating weapons, illegal drugs, or other unlawful items.
• Constitutes fraud, identity theft, money laundering, or other financial crime.

2.2 Voice-Based Fraud and Impersonation

• Impersonates a real person without their explicit, informed, written consent.
• Clones or imitates the voice of any public figure, politician, celebrity, or other identifiable person without their express consent specific to AI voice cloning.
• Generates synthetic voice content intended to defraud, deceive, or scam another person.
• Creates voice messages purporting to be from a real person for the purpose of obtaining money, personal information, or unauthorized access to systems.
• Generates synthetic voice content for use in social engineering, phishing, or vishing (voice phishing) attacks.

2.3 Deepfake and Synthetic Media Misuse

• Creates synthetic audio that misrepresents what a real person said or did, when distributed without clear AI-disclosure labels (i.e., classic deepfake content).
• Generates voice clones of deceased individuals for commercial purposes without estate consent.
• Produces non-consensual intimate or sexual content depicting any real person.
• Creates content for use in election interference, voter suppression, or political manipulation, particularly content depicting real candidates or political figures.

2.4 Harassment, Hate, and Defamation

• Harasses, threatens, defames, or defrauds any individual or group.
• Promotes violence against, or incites hatred toward, individuals or groups based on race, ethnicity, religion, gender, sexual orientation, gender identity, disability, age, national origin, or other protected characteristics.
• Promotes self-harm, suicide, or eating disorders.
• Constitutes cyberbullying, doxxing, or non-consensual sharing of personal information.

2.5 Intellectual Property Violations

• Infringes on copyrights, trademarks, or other intellectual property rights of any third party.
• Generates audio versions of copyrighted books, articles, or other works that you do not own and have not licensed.
• Reproduces copyrighted song lyrics, scripts, or screenplays without authorization.
• Violates the right of publicity of any person.

2.6 Privacy and Confidentiality Violations

• Generates content that contains personal information about a third party that you obtained without authorization.
• Discloses confidential or trade secret information you have a duty to protect.
• Generates content that violates patient privacy under HIPAA, PIPEDA, GDPR, or similar laws.
• Uploads, submits, or processes Protected Health Information (PHI) or other regulated health records as input. VocalMax is not a HIPAA-covered service and must not be used to create, receive, maintain, or transmit PHI.

3. Prohibited Uses of the Service

You may not, regardless of the content of your audio:

• Reverse-engineer, decompile, or attempt to extract the source code of VocalMax.
• Use VocalMax to develop competing products or services.
• Resell, sublicense, or redistribute VocalMax's voice models, voiceprints, or AI capabilities to third parties.
• Circumvent security or access controls, including word limits, voice clone limits, or paywalls.
• Use automated tools (bots, scrapers, scripts) to access the Service in ways not permitted by our API terms.
• Share account credentials with unauthorized users.
• Create multiple accounts to evade limits, bans, or refund-eligibility restrictions.
• Engage in any activity that interferes with or disrupts the Service, our infrastructure, or other users' access.
• Use the Service to generate content for use in facial recognition, voice recognition, or biometric matching systems without our prior written consent.
• Resell VocalMax-generated audiobooks under terms inconsistent with the commercial license described in our Terms of Service.

4. Use by Minors

VocalMax is intended for users 18 years of age or older. We do not knowingly collect personal information from minors. If you become aware of any account being used by a minor, contact us at privacy@vocalmax.ai for immediate removal. The voice cloning feature is particularly restricted: we do not permit voice cloning of minors under any circumstances.

5. Age-Restricted Content

Adult-themed audiobook content (such as romance with explicit sexual content) is permitted, provided that:

• All depicted persons are clearly adults (18+).
• The content does not violate any law in your jurisdiction.
• The content is not generated using voice clones of real people without their consent (especially performers, voice actors, or celebrities).
• You appropriately label and gate the audiobook on distribution platforms (e.g., Audible adult content rating).

6. Enforcement

We may monitor for AUP violations, including through:

• Automated systems that may scan for potentially prohibited content.
• User reports submitted via support@vocalmax.ai or in-app reporting tools.
• Reports from third parties, including copyright owners, voice cloning subjects, and law enforcement.

If we determine that you have violated this AUP, we may, at our discretion:

• Issue a warning.
• Remove specific content from your account.
• Restrict your access to specific features (e.g., voice cloning).
• Suspend your account temporarily.
• Terminate your account permanently.
• Forfeit any unused subscription time and Word Pack credits.
• Pursue legal action.
• Report violations to law enforcement, where required or appropriate.

7. No Private Right of Action

This AUP creates obligations between you and Brilliant5 Inc. It does not create a private right of action for any third party. If you believe another user is violating this AUP, you may report the violation to us, but you have no contractual right to compel us to take any specific enforcement action.

8. Reporting Violations

To report a violation of this AUP:

• For copyright infringement, follow the procedures in our DMCA & Copyright Infringement Policy.
• For voice cloning misuse (impersonation, deepfake, etc.), email abuse@vocalmax.ai with details and links.
• For child sexual abuse material, contact us immediately at abuse@vocalmax.ai. We treat such reports with the highest priority.
• For all other AUP violations, email support@vocalmax.ai.

9. Updates to This Policy

We may update this AUP from time to time. Material updates will be communicated via email to active subscribers and via an in-app notification. Continued use of the Service after the effective date of an update constitutes acceptance of the updated AUP. If you do not accept an updated AUP, you must stop using the Service and may delete your account.
